The Supreme Court told the need for the formation of a special CBI court … asked the government to provide infrastructure

Expressing concern over the long pendency of criminal cases against MLAs and MPs, the Supreme Court has said that there is a need to set up more special and CBI courts to deal with this matter. The Supreme Court has asked the central and state governments to help in providing infrastructure wherever there is a need to set up special courts.

Order on application of BJP leaderThe Supreme Court passed the said order during the hearing on the application of BJP leader Ashwini Upadhyay. Upadhyay has said that a special court should be set up for speedy disposal of pending criminal cases against MPs and MLAs. The Supreme Court in its judgment has said that one or two special courts in the state would be a travesty of justice as there are a large number of pending cases.

The example given of Madhya PradeshGiving the example of Madhya Pradesh, the Supreme Court said that there is a special court in Bhopal, it is not possible to physically produce people from different areas of the state. This is a mockery of justice. The Supreme Court said that there is a need to set up several special courts and CBI courts in the states. It is not possible to have a trial in one or two special courts in the state.

Said to set up special courtThe Supreme Court has suggested that special courts should be formed in different areas of the state and where there are more than 100 pending cases, courts should be constituted. The Supreme Court has asked the High Court to set up special courts wherever necessary for the trial of pending cases. The Supreme Court said that the Central Government and the State Governments should provide adequate infrastructure to the High Court so that special courts can be constituted according to the need.

Concerned over pendency of cases: Supreme Court The Supreme Court said that we do not want to go into the pending cases separately but we are concerned about the current pendency. The Supreme Court said that the Solicitor General has said before the court that he will take up the matter with the CBI Director so that the CBI gets adequate manpower and infrastructure so that the investigation can be completed in time. The court said that the High Court is asked to ensure that timely trial of such cases is ensured.
